An order is only final once payment has been received and confirmed by Nurture by Mama. Nurture by Mama reserves the right to refuse an order or to request additional information.

Right of Withdrawal

​

A consumer may cancel an online purchase within a 14-day reflection period without stating a reason, provided that:

• the product has not been used,

• it is not a product that cannot be returned for hygienic reasons (underwear),

• the seal is still intact.

The 14-day reflection period starts:

• on the day following the receipt of the final product or component from a single order.

• The consumer can invoke the right of withdrawal by contacting info@nurturebymama.nl.

• The consumer is required to return the product to Nurture by Mama within 14 days after invoking the right of withdrawal. If the product is not returned within this period, the right of withdrawal expires.

 

Return Costs

1. The cost of return shipping is the responsibility of the customer.

2. If the consumer has invoked the right of withdrawal in time and subsequently returns the complete order to Nurture by Mama within the required period, Nurture by Mama will refund the amount paid by the consumer within 14 days of receipt.

Set-off

​

Unless the customer is a consumer, the customer waives the right to offset a debt to Nurture by Mama against a claim on Nurture by Mama.

Retention of Title

​

1. Nurture by Mama remains the owner of all delivered products until the customer has fully met all payment obligations owed to Nurture by Mama under any agreement, including claims relating to failure to comply with such agreement.

2. Until then, Nurture by Mama may invoke retention of title and reclaim the goods.

3. Before ownership has been transferred, the customer may not pledge, sell, transfer, or otherwise encumber the products.

4. If Nurture by Mama invokes retention of title, the agreement is considered dissolved, and Nurture by Mama is entitled to claim compensation for damages, lost profits, and interest.

Delivery

​

1. Delivery is subject to availability.

2. Delivery takes place at Nurture by Mama unless otherwise agreed.

3. Delivery of online orders takes place at the address provided by the customer.

4. If the agreed payments are not made or not made on time, Nurture by Mama has the right to suspend its obligations until payment is fulfilled.

Delivery Time

​

1. Delivery times stated by Nurture by Mama are indicative and do not entitle the customer to dissolution or compensation in the event of delay, unless expressly agreed otherwise in writing.

2. The delivery time begins when the order process has been fully completed and Nurture by Mama has issued an (electronic) confirmation.

3. Exceeding the stated delivery time does not entitle the customer to compensation or dissolution of the agreement, unless Nurture by Mama is unable to deliver within 14 days after a written notice to do so, or unless otherwise agreed.

Packaging and Shipping

​

1. If the packaging of a delivered product is opened or damaged, the customer must have a note made of this by the carrier before accepting the product. If not, Nurture by Mama cannot be held liable for any damage.

2. If the customer arranges transportation of a product themselves, any visible damage to the product or packaging must be reported to Nurture by Mama prior to transport; otherwise, Nurture by Mama cannot be held liable for any damage.

Warranty

​

1. The warranty applies only to defects caused by poor manufacturing, construction, or materials.

2. The warranty does not apply in cases of normal wear and tear, damage resulting from accidents, modifications to the product, negligence, or improper use, nor when the cause of the defect cannot be clearly established.

3. The risk of loss, damage, or theft of products subject to an agreement passes to the customer once they have been legally and/or physically delivered, or otherwise come into the possession of the customer or a third party receiving the product on behalf of the customer.

Complaints

​

1. The customer must examine the delivered product or service as soon as possible for any shortcomings.

2. If a delivered product does not meet what the customer could reasonably expect, the customer must notify Nurture by Mama as soon as possible, and in any case within 1 month after discovery of the shortcomings.

3. Consumers must notify Nurture by Mama of shortcomings no later than 1 month after discovery.

4. The customer should provide as detailed a description as possible so that Nurture by Mama can respond within 14 days.

Liability

​

Nurture by Mama is not liable for damage caused by incorrect use of the products. Our liability is in all cases limited to the purchase amount.

​

Modification of the Agreement

​

If, after conclusion of the agreement, it appears necessary to modify or supplement its content for implementation, the parties will amend the agreement accordingly in mutual consultation.

​

Modification of General Terms and Conditions

​

Nurture by Mama is entitled to amend or supplement these general terms and conditions.

1. Minor changes may be made at any time.

2. The most recent version is always available on our website.

3. Applicable Law and Jurisdiction

​

All agreements and disputes are governed by Dutch law.
